Terms and Conditions

Here listed are the terms and conditions (T & Cs) for Jonathan Dredge and Samantha Thomas, Chalet Pierre sur Haute, 216 Route Des Bois Venants, 74110, Morzine. Hereafter referred to as “moremountain”.

1.0 - AGREEMENT
The terms and conditions of this document together with your booking form comprise the agreement between moremountain and all those listed on the booking form, on whose behalf the group leader has signed. The contract is deemed to have been made as soon as the signed booking confirmation form is received by moremountain.

1.1
The group leader is responsible, on behalf of all other members of the group, for all matters relating to the booking, thus he/she will be personally liable for all monies outstanding from the remainder of the guests.

1.2
"The group" refers to all persons booked to stay in the accommodation listed on the booking form and also includes any subsequent changes of names to the original booking.

1.3
If at any time, prior to the start of the holiday, there is a change of group leader moremountain must be notified, either by email or telephone, by the original group leader and a new booking confirmation and terms and conditions form must be signed by the new group leader and returned to moremountain before embarking on the holiday.

2.0 - BOOKING

2.1
Once availability has been confirmed, by moremountain, a booking enquiry will be held for 7 working days, pending receipt of the appropriate deposit (£150 per person) and completed booking form.

2.2
Thereafter the booking will be deemed cancelled and moremountain reserves the right to re-book the week without notification.

2.3
The total amount outstanding on your holiday must be paid within 8 weeks of departure. For bookings made within this period the full cost of the holiday will be payable at the time of booking.

2.4
If the final balance is not received 8 weeks prior to the day the holiday commences moremountain reserve the right to cancel the booking and any deposits paid will be forfeited (every effort will be made to contact the client to remind them of payment dates). Moremountain then reserves the right to re-book the chalet without further notice.

2.5
If you change any of your flight details after having booked your holiday, and moremountain have made arrangements on your behalf, an administrative charge may be incurred which will be added to your balance.

3.0 - PRICES

3.1
The prices stated within the brochure are for transfers to and from Geneva airport, one weeks (7 nights) accommodation, evening meals with wine and beer on 6 nights and breakfast on 7 mornings. Prices do not include flights or travel costs; travel, holiday and medical insurance; lift passes; childcare; equipment hire or lessons.

3.2
Moremountain guarantees the price of the holiday as quoted at the time of booking and reserves the right to increase or decrease the price of unsold holidays at any time.

4.0 - PAYMENT

4.1
Acceptable payment types are Bank Transfer, Cheque, Bankers Draft, and Credit Card - credit card payments incur a charge and are taken in euros. Moremountain use www.xe.com on the day of payment to calculate exchange rates.

4.1b
Moremountain will not be responsible for charges imposed on you, by your bank or credit card issuer. This also includes payment discrepancies caused by variations in exchange rates used by your bank / credit card issuer.

4.2
In the event of dishonoured payment the group leader will be contacted to make immediate payment by other means. Failure to do this will mean automatic cancellation of the booking.

4.3
In the event of late payment of your final balance, charges or loss of revenue incurred on our behalf will be added to your balance.

5.0 - CANCELLATION

5.1
Due to circumstances beyond moremountain’s control it may be necessary to make alterations to a confirmed booking or to cancel the booking completely. Whilst moremountain will make every effort to ensure this does not happen, if it is unavoidable, moremountain will contact the group leader as soon as possible. In this instance moremountain will endeavour to make alternative arrangements for accommodation (of the same value) if available, or offer a full refund of any monies paid. No other compensation will be offered.

5.2
This compensation does not include events amounting to Force Majeure (Force Majeure meaning war, political unrest, weather, strikes, acts of God, epidemics, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters, nuclear war) or if the client defaults in the payment of the final balance

5.3
You, or any member of your party, may cancel your holiday at any time providing that the group leader makes the cancellation in writing/email.

5.4
Moremountain takes no responsibility for non-delivery or non-receipt of such written cancellation.

5.5
Your deposit will be retained for administration costs and cancellation charges will be levied as follows:
4 - 6 weeks before commencement of holiday: 50% of total holiday cost
2 - 4 weeks before commencement of holiday: 75% of total holiday cost
Less than 2 weeks before commencement of holiday: 100% of total holiday cost

5.6
Non receipt of the balance of the cost of the holiday will not be taken as notification of cancellation; clients will still be liable for cancellation charges as shown above if they subsequently cancel the holiday.

6.0 - LIMITATION OF LIABILITY

6.1
Moremountain does not accept any liability wheresoever or howsoever arising, or pay compensation for:

  1. Any event which moremountain could not foresee or avoid, amounting to Force Majeure (Force Majeure meaning war, political unrest, weather, strikes, acts of God, epidemics, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters, nuclear war)
  2. Any cancellation, loss, delay or costs wheresoever or howsoever arising or connected with adverse weather or traffic conditions, avalanche, mud slips, slides and snow conditions and the effect any of these may have on travel arrangements, accommodation and activities.
  3. limitations imposed by resort authorities, ski-lifts, ski school or ski hire operators.
  4. travel arrangements made by the group or on behalf of the group.
  5. Any personal injury or death wheresoever or howsoever arising caused to any visitor and/or any member of the group for their duration of stay. This is not intended to exclude any statutory rights the group and/or visitor may have. This agreement and any proceedings there under are to be governed by English Jurisdiction.

6.2
A person who is not a party to this Contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Contract provided always this does not affect any right or remedy of a third party which exists or is available apart from this Act.

7.0 - ARRIVAL/DEPARTURE TIMES

7.1
The chalet is available for access after 4 pm on the day of your arrival. If, however, you arrive earlier you are welcome to leave your luggage with us whilst you pop into town for a coffee or beer. The same conditions apply to self-drive guests.

7.2
For departure, rooms must be vacated by 11 am. If you would like to ski on your last day, and consequently are planning to book a later return flight, moremountain can store your luggage in the chalet free of charge. Moremountain cannot guarantee a room being available to shower or change in and you must vacate the Chalet by 3 pm.

8.0 - TRANSFERS

8.1
Moremountain have included the cost of your transfer to and from Geneva Airport within the overall price of your holiday. Our regular changeover day is Sunday for Chalet Robin and Saturday for The Loft.

8.2
Upon arrival at Geneva you will be greeted by a skilifts representative, shown to your mini bus and driven to your chalet. Weather and road conditions permitting the journey should take no longer than 90 mins.

8.3
In the case of unforeseen circumstances, out of moremountain or skilifts’ control, such as flight delays, cancellations, lost luggage, adverse weather and road conditions, you may be required to wait in the airport arrivals café area for a maximum of 1 hour. If this happens, you will be notified immediately upon arrival and kept informed of the situation by a designated skilifts representative.

8.4
If you are travelling in a smaller party, you may also be required to wait at the airport for a maximum of one hour. Alternatively a private transfer can be arranged for an additional charge.
For your return journey, it may be necessary for us to allow up to 4 hours to transport you safely to the airport, due to adverse weather conditions.

8.5
Any decisions regarding departure times from Morzine will be made by a skilifts representative in conjunction with moremountain. Moremountain will notify you on the evening before your departure. Skilifts and moremountain will always allow adequate time to ensure you arrive safely, and on time for your flight home.

8.6
8.6 Any costs incurred due to unforeseen circumstances resulting in you missing your flight should be claimed against your holiday insurance. Moremountain can provide you with any paperwork required to support such a claim.

PLEASE NOTE...

8.7
For transfers outside our normal changeover days, and for in-correct information supplied by yourself, requiring us to arrange additional transfers at short-notice, moremountain reserve the right to charge the price quoted on the Skilifts website for Geneva transfers.

8.8
Moremountain provide a free transportation service in resort for your convenience, the use of this vehicle is taken entirely at your own risk and moremountain take no responsibility for death or personal injury caused through the use of this service Please note that the use of the vehicle is provided free of charge and does not form part of the holiday cost.

9.0 - RESPONSIBILITIES AND BEHAVIOUR

9.1
All guests should act and behave in such a manner as to not affect or disrupt the enjoyment of other guests, the local residents or have a negative effect on the reputation of moremountain. Excessive noise inside or within the chalet grounds also comes under this clause.

9.2
Any persons not booked into a moremountain chalet can only visit guests with prior notification and permission of chalet staff, with chalet staff being present at all times. If a client is in breach of the terms and conditions moremountain reserve the right to refuse to further accommodate them and contractual obligations will be terminated immediately.

9.3
Any loss or damage wheresoever or howsoever caused or arising by the group leader or members of the group to moremountain vehicles, property, grounds and outbuildings must be paid in full - payable by the group leader, on behalf of the group, irrespective of which person was responsible. This is to be paid to moremountain, by the payment details supplied at time of booking, before the group's departure.

10.0 - OUTDOORS SHOES

10.1
It is important that, for your comfort, a pair of slippers or indoor shoes are included in your packing as outdoor shoes are strictly forbidden inside the chalet.

11.0 - SMOKING

11.1
For health and safety reasons smoking is strictly prohibited within the chalet and company vehicles. If people wish to smoke they must do so outside of these areas.

12.0 - CHILDREN

12.1
No matter how much care is taken, our chalet is not childproof. Moremountain will not be held responsible for any accidents occurring within the chalet, it is the parent’s responsibility to ensure their children are supervised at all times.

13.0 - COMPLAINTS

13.1
In the unlikely event of you having a complaint with any part of your holiday you should notify the chalet staff immediately.

13.2
Any complaints made after departure will not be considered. Complaints cannot be accepted for snow conditions, childcare, weather, lessons and closures of ski - lifts.

14.0 - THIRD PARTY ACTIVITES

14.1
Moremountain can assist in sourcing and booking many of the extra services you may need when on holiday, these services are subject to the terms and conditions of the individual companies.

14.2
Our help does not constitute an approval and moremountain take no responsibility or liability for his or her service. Any grievance with a third party service should be taken up with the provider directly.

15.0 - LOST AND STOLEN PROPERTY

15.1
Any client not properly securing the exits after leaving the chalet will be liable for any property stolen as a result of that negligence.

15.2
Moremountain will not be held responsible for any theft or loss of personal possessions from our premises / vehicles. Whilst moremountain will endeavour to ensure the security of guests’ personal possessions, moremountain cannot guarantee it.

15.3
It is up to the group leader to ensure that each member of the party is responsible for the safety of all their own personal possessions, documents and equipment. No responsibility or liability is or will be accepted in respect of such items.

16.0 - SKI/SNOWBOARD COMPANIONS

16.1
Moremountain offer a ski/snowboard companion service, to show you around the marked pistes and links around the Portes du Soleil area, to guests of moremountain.
Please note this is NOT ski guiding - our staff are not professional ski guides in that they do not hold a ski guide qualification or have the necessary insurance. Under no circumstances will our staff offer off piste guiding and if you choose to venture off piste whilst in the company of a staff member you will be strongly advised against any such action unless you employ a Professional mountain guide and the appropriate equipment. Should you choose to ignore our advice, you assume all responsibility for your actions and the inherent dangers of off piste skiing / snowboarding.

16.2
It must be noted that this is a totally free service, not constituting any part of your holiday, and may be withdrawn at any time, without notice or liability, due to hangovers, bone idleness or ski companion stating "if you think I am going out in this you must be stupid!"

17.0 - PASSPORT AND VISA

17.1
It is your responsibility to be in possession of a valid passport and/or any visa necessary. If you do not have a British or EC passport, please be sure to check visa requirements for the countries you will be visiting. Remember, most flights are to Geneva in Switzerland which is not an EC member.

18.0 - INSURANCE

18.1
Skiing and snowboarding can be a dangerous pursuit both on and off piste, Moremountain will endeavour to make your trip as safe as possible, but not all risks, dangers and hazards can be anticipated or avoided. Therefore you MUST be insured before partaking in a winter holiday.

18.2
It is up to the group leader to ensure that each member of the group has all their own necessary medical and travel insurance documents to cover themselves fully before embarking on the holiday and moremountain will need evidence of this upon arriving at the chalet. Please see our links page to view insurance providers moremountain have used in the past.

19.0 - TERMS OF CONTRACT

19.1
All descriptions on this website are given in good faith and are believed to be correct. This is in relation to all aspects including activity pricing and information.

19.2
For the avoidance of doubt in the event of any conflict the provisions of the Ts and Cs prevail.

19.3
The contract is made on the terms of these booking conditions and governed by English Law. Both parties shall submit to the jurisdiction of English Courts at all times.
